Welcome to FleetFluxus, a comprehensive passenger transportation platform designed for universities, hospitals, school districts, municipalities, and private transportation companies. Our platform includes a driver app for managing passenger pickups and drop-offs, live vehicle tracking, real-time notifications for guardians, navigation tools, and an advanced dashboard for reporting and analytics.

By accessing or using FleetFluxus, you agree to abide by these Terms and Conditions. If you do not agree with any part of these Terms, please do not use our platform.

Definitions

  • “Platform” refers to FleetFluxus, including its driver app, dashboard, and associated services.
  • “User” refers to any individual or entity accessing or using the FleetFluxus platform.
  • “Driver” refers to the individuals operating vehicles using the FleetFluxus app.
  • “Passenger” refers to the individuals being transported using FleetFluxus services.
  • “Guardian” refers to the legal parent or guardian of a passenger receiving notifications.
  • “Administrator” refers to the entity overseeing transportation operations using FleetFluxus.

User Eligibility & Registration

  • Users must be legally eligible to enter into contracts and, if registering as an organization, must be authorized to act on behalf of their entity.
  • Drivers must hold a valid driver’s license and comply with all applicable transportation laws.
  • Organizations using FleetFluxus must ensure compliance with local, state, and federal regulations regarding passenger transport.
  • Users must provide accurate and up-to-date information when registering on FleetFluxus.

Use of the Platform

  • FleetFluxus provides real-time tracking, scheduling, and reporting for passenger transportation.
  • The driver app allows authorized drivers to receive trip requests, navigate routes, and confirm pickups/drop-offs.
  • Guardians receive automated notifications regarding pick-up times, estimated time of arrival (ETA), and drop-off confirmations.
  • Administrators can monitor vehicle movement, optimize operations, and analyze transportation data.
  • FleetFluxus integrates navigation tools to assist drivers in following optimized routes.

Users agree not to misuse FleetFluxus, including but not limited to:

  • Providing false or misleading information.
  • Attempting to hack, interfere with, or reverse-engineer the system.
  • Using the platform for unauthorized or unlawful activities.

Driver Responsibilities

  • Drivers must follow all traffic laws and safety regulations while using the platform.
  • Drivers must ensure passenger safety during transportation.
  • Drivers must not engage in reckless or negligent behavior that endangers passengers or others.
  • Drivers are responsible for maintaining a working mobile device with GPS functionality for real-time tracking.

Passenger & Guardian Notifications

  • FleetFluxus provides real-time notifications to guardians about pick-up and drop-off status.
  • ETA notifications are estimates and may change due to unforeseen circumstances (e.g., traffic, weather, delays).
  • Guardians must ensure that passengers are ready for pickup at the scheduled time.
  • FleetFluxus is not responsible for delays or missed pickups due to passenger unavailability.

Data Privacy & Security

  • FleetFluxus collects and processes personal data to enhance transportation services, including:
  • Passenger and guardian contact details.
  • Driver information and vehicle details.
  • GPS and trip history data.
  • User data is protected and not shared with third parties without explicit consent, except when required by law.
  • FleetFluxus uses encryption and security protocols to safeguard personal information. For more details, refer to our Privacy Policy.

Fees & Payment

  • Organizations and transportation providers using FleetFluxus may be required to pay a subscription or usage fee.
  • Fees will be outlined in the pricing agreement between FleetFluxus and the user.
  • Payments are non-refundable unless explicitly stated otherwise.
  • FleetFluxus reserves the right to suspend or terminate access due to non-payment.

Platform Availability & Updates

  • FleetFluxus aims to provide 24/7 system availability, but we do not guarantee uninterrupted service.
  • We may conduct updates, maintenance, or enhancements, which may result in temporary downtime.
  • FleetFluxus reserves the right to modify, improve, or discontinue any feature at any time.

Limitation of Liability

  • FleetFluxus is a technology provider and is not liable for any accidents, injuries, or damages resulting from transportation services.
  • We do not guarantee 100% accuracy of ETAs or GPS tracking due to potential external factors (e.g., weather, road conditions).
  • Users acknowledge that FleetFluxus is not responsible for any operational decisions made by drivers or administrators.
  • To the maximum extent permitted by law, FleetFluxus shall not be liable for any indirect, incidental, or consequential damages arising from platform use.

Termination of Access

  • FleetFluxus reserves the right to suspend or terminate user access if:
  • There is a violation of these Terms and Conditions.
  • The user engages in fraudulent, unsafe, or unlawful activities.
  • The user fails to make required payments.
  • Users may terminate their account at any time by contacting FleetFluxus support.

Governing Law & Dispute Resolution

  • These Terms and Conditions shall be governed by the laws of the United States.
  • In case of disputes, parties agree to first attempt resolution through negotiation before pursuing legal action.
  • Any legal disputes shall be handled in the courts of Washington, D.C.

Amendments & Updates

  • FleetFluxus reserves the right to modify these Terms and Conditions at any time.
  • Users will be notified of significant changes via email or in-app notifications.
  • Continued use of FleetFluxus after modifications constitutes acceptance of the updated Terms.
